Supreme Court Throws Out Dengvaxia Petition 5 Years After Filing. Philippines Inflation at a14-Year High. BioNTech and Pfizer Falsified Key Data used for Product Approvals, Lowered Quality Standards.
Proven falsification of data voids liability protections. How did Pfizer / BioNTech think they could get away with this? How were the regulatory agencies so lax as to overlook this?
Dengvaxia Petition Thrown Out
In 2015 former President Aquino III approved the commercial sale and use of the Dengvaxia vaccine, making the Philippines one of the first Asian countries to approve the use of this Sanofi Pasteur product.
In 2016 the Philippines Children’s Medical Centre procured 600,000 vials of Dengvaxia at a cost of PHP3.5 billion, and a school-based dengue vaccination program was implemented in NCR, Region III and Region IV-A.
In 2017 Sanofi Pasteur released a statement that their vaccine posed a risk of severe dengue when given to persons who had not previously had dengue (i.e. the vaccine is only beneficial to those “who had prior infection”). Dengue is an infection whereby the first infection can prime for a worse infection in case of infection with a second, slightly different variant. In this case, it appeared that vaccine was acting as a “first infection”. The school vaccine program was suspended by December 2017. Subsequently the use of this vaccine was banned in the Philippines [Source].
Children have died of severe dengue after receipt of this vaccine. The Philippines Public Attorney’s Office (PAO) has been involved in the cases and investigations.
In December 2017, petitioners (parents of 74 Dengvaxia vaccinated children) filed a petition for Mandamus1 before the supreme court. This case was not filed under PAO. The petition by parents of 74 children vaccinated for dengue had been calling for public reporting on the Dengvaxia programe, safety studies on Dengvaxia, creation of a registry for all persons inoculated with Dengvaxia, and provision of monitoring and free medical care for any related illness2. In a decision issued on 6th February 2023, the Supreme Court En Banc has dismissed the petition.
The decision stated that while the petitioners were found to have standing to bring the case, it was dismissed as 1) violating the doctrine of hierarchy of courts; “should have been filed first before the regional trial court”. 2) It does not involve the enforcement or violation of an environmental law or right. 3) The reliefs prayed for by the petitioners involve purely administrative and discretionary functions. 4) Petitioners failed to demonstrate that the vaccine failed to satisfy safety and health standards, 5) the reliefs sought by the petitioners have already been provided.
Dengvaxia is often credited as causing the vaccine hesitancy in the Philippines. The Dengvaxia saga is not over. All vaccinated children, many now young adults, will live their lives in fear of catching dengue, in fear of having a fatal case, as a result of taking a product they were told would protect.
Last year in response to increasing dengue cases, there was some movement by DOH to consider reintroducing Dengvaxia.
PAO opposed this, with forensic pathologist Dr. Erfe claiming that there could be many more victims that have been publicly acknowledged.
Covid-19 Injectables Serious Adverse Events of Special Interest 1 in 800.
Covid-19 vaccines themselves are now adding to that hesitancy. Uptake is low despite wide availability of the Covid-19 injectables! Total doses to Filipinos as of 5th Feb 2023 are 170,138,534 (including 3,882,186 2nd boosters not included below). Discussions with persons on the street well acknowledge that these jabs have poor outcomes for many.
If the currently acknowledged serious adverse events of special interest occur at a rate of 1/800 doses, there will be over 200,000 Filipinos currently dealing with consequences of their choice to trust Government.
Inflation at a 14-Year High
Life is already very tough for most in this country, and it looks set to get harder with soaring costs of living!
PSA has released inflation figures for January 2023. Inflation started rising in May of 2022 and in January 2023 stood at 8.7%, a 14 year high.
Soaring inflation is particularly bad news in a country where most of the population have no reserves and live hand to mouth from one payday to the next. Minimum legal daily wage in Manila is PHP570 (USD10.36) before government mandated social security deductions. This is hardly a living wage, and can barely feed, house, and clothe a family let alone cover schooling, medical care, or provide any luxuries! Suprise inflation at 8.7%?
Pfizer and BioNTech Falsified Key Data Presented for EUA Approvals
We suspected that this was the case, and now we know it for a fact! Bombshell evidence is presented by Sonia Elijah though her brilliant forensic investigation showing the Western Blot Outputs used to evaluate the protein expression of mRNA in HEK cells transfected with vaccines were cut and paste duplicates (to enhance consistency / quality data) which was then submitted to the European Medicines Agency and US-FDA who then issued approvals. Other concerns such as the dropping of the % integrity of vaccine mRNA from 78% in the clinical batches to 55% in the commercial batches (a massive lowering of quality standard, with unknown safety and efficacy impacts) are also discussed!
Petition For Mandamus A mandamus is an order to a public agency or governmental body to perform an act required by law when it has neglected or refused to do so. A person may petition for a writ of mandamus when an official has refused to fulfill a legal obligation. For this Dengvaxia case the petitioners claimed that there was failure by officials “to protect the right to health of every Filipino”, a duty mandated by the constitution and other laws. Included in the response, the court has countered that Mandamus is applicable to ecological cases and violations.
Petitioners had asked that the respondents be ordered to: -
1) “publicly disseminate, on a regular basis, the report of the Task Force creased and designated to monitor and review the school-based immunization program involving Dengvaxia and submit the same to the House of Representatives and Senate Committees on Health;
2) conduct further study and review on the safety and efficacy of Dengvaxia, which should be open to the public and subject to review by independent medical experts;
3) create a registry or list of all those who had been inoculated with Dengvaxia;
4) provide free medical services to all inoculated children and monitor any adverse effects caused by the vaccine;
5) Provide free medical treatment and hospitalization to inoculated children if they suffer from a Dengvaxia-related illness; and
6) conduct initial and free consultations of inoculated children in all areas covered by the program.
